DEC Success Criteria of Disposition Process

This Statement by the Devens Enterprise Commission describes how the DEC will consider its participation in the Disposition Process as successful and in concert with efforts of DDEB and its subordinate boards in arriving at and recommending to the legislature a disposition for Devens and executing a transition to the new jurisdiction(s)

During the Disposition Decision process the DEC will continue with its normal regulatory business in accordance with Chapter 498, the Re-Use Plan, and the Devens by-laws and regulations, and as the foregoing may be properly amended during the disposition process.

A transition period from the present Devens governance to a new governance(s) is envisioned sometime after the DDEB submits its disposition recommendation to the Massachusetts legislature. During this transition period the DEC will continue its normal regulatory business as stated in the preceding paragraph.

However, during this transition period the DEC and its staff is also available to work with the proposed future jurisdiction(s) to help analyze, critique, plan and document proposed departures from the present Re-Use plan and Devens rules and regulations. These departures will be reconciled against the by-laws of the new jurisdiction(s) for compliance or required amendment thereof.

Until Devens Disposition1 takes place, the Devens by-laws and regulations, the Re-Use Plan, and Chapter 498 will prevail at Devens until amended or replaced by the new governance(s) after disposition1 takes place.

The DEC will review disposition proposals against the original goals of the ReUse Plan developed by the citizens of the region, including but not limited to:

  • "Development must be sustainable, which means achieving a balance of economic, social, and environmental needs, while maintaining and enhancing the natural resource base.
  • Provide a diversity of uses to avoid dependence on one type of land use, and to provide employment opportunities for a range of skill and experience levels.
  • Achieve success. Demonstrate the interdependence of economic development and environmental protection and the symbiosis of public and private uses.
  • Balance local, regional and state interests."
  • Retain an expedited or unified permitting system.
1 The DEC's definition of Disposition is as follows: The actual disposition of Devens is the date the changes to political jurisdiction(s) over Devens actually take place in accordance with what has been approved and made into law by the Massachusetts State Legislature.
